Justlets Terms of Business

These terms set out the agreement between you as the landlord and us as Justlets. We offer Lettings Only and Managed Lettings Services.

Before we can provide you with any of our services there are certain actions you, as owner must take.

You must-

* obtain your lender and / or lessor’s agreement to the tenancy and inform us of all special conditions they attach to their agreement.

*Order a Landlord’s EPC and provide us with either a hardcopy, a pdf copy or an internet link of it.

* Inform your insurance company that your property is to be let. Ensure your buildings and/or contents insurance cover remains adequate and in force. We recommend that a dedicated Landlord Policy is taken out rather than just obtaining the agreement of your current insurer as there have been instances of claims being refused, that a dedicated insurance policy would cover you for.

*Inform us of what contents you will leave in the property during the tenancy and remove items that are not to be included. A full inventory and/or schedule of the condition of the contents is advisable, to prevent any disputes at the end of the tenancy.

*State any preference for a particular type of tenant; eg professional couple, no children, no pets...etc

*Provide us with a correspondence address.

*Supply us with two sets of keys.

* Ensure that the property is clean and left in good decorative order so that it is available for immediate occupation.

 

Lettings Only Service

If you instruct us on a Lettings Only basis, we will:

Advise you on the type of tenancy

Advise you on the rent you could expect to receive

Advise you on our marketing and tenant matching process

Advise you on what furniture to provide

Advise you on your responsibilities as a landlord

Issue you with guidelines on the following:

The Furniture & Furnishings (Fire) (Safety) regulations 1998 (as amended)

The Electrical Equipment (Safety) Regulations 1994

The Gas Safety (Installation and Use) regulations 1998

The Plugs and Sockets etc (Safety) Regulations 1994

Arrange appointments for prospective tenants to view the property

Deal with any applications and take up references on prospective tenants. Conduct Credit Checks and advise you of the outcome.

Arrange for the drawing up of the inventory and/or schedule of condition.

Prepare and arrange for the completion of the standard Tenancy Agreement and any other relevant documents.

Collect the deposit and the first payment of rent due under the terms of the tenancy from the tenant and forward this to you. Under the Housing Act 2004 you must lodge the deposit with one of the three Tenancy Deposit Protection Schemes within 14 days of the start of the tenancy.

Advise on how to ensure that the tenant takes over responsibility for payment of Council tax and Utilities at the  property. We are happy to do this for you.

Submit an itemised statement of income and our costs as soon as possible after the tenancy starts

Managed Lettings

As no two landlords or tenants are the same, we also offer a Managed Lettings Service on a flexible basis. Let us know how you would like the property to be managed, and we will design our services to suite your requirements. Fees are applied as you need the service. Generally we start with the Letting & Rent Collection agreement, and apply the additional charges as you need them.

We will of course advise you in advance, in writing of the charge for the additional service/s. We are here to assist with the smooth running of the letting process.

General

The following conditions apply to both our Lettings and Lettings & Rent Collection Services.

1. Where legal action is necessary against the tenant,

it will be your responsibility to instruct solicitors to commence proceedings. You must pay the cost of such proceedings.

2. If we are needed to attend a court or tribunial on your behalf you may

have to pay us additional fees.

3. We will use our standard tenancy agreement.

4. We normally recommend that you offer a fixed period e.g. 6 months.

5. If you reside outside of the UK you must inform Inland Revenue of your rental income. If you are exempt you must supply us with a copy of your Exemption Certificate.

6. We reserve the right to vary the Terms of Business by giving you 28 days

notice.

Termination

The following conditions apply to the termination of our services:

If we are unable to let your property, you may withdraw your instructions. We request that you provide this request in writing.

If we consider that you are in breach of any regulations relating to the property, we may give you notice that we intend to withdraw our services.

Either you or we may end the agreement by giving not less than 1 calendar month’s written notice to the other. If you give notice to the end of an on-going tenancy you must pay us all monies owed under the agreement up to the date of the ending agreement. We reserve the right to charge any fees due under this agreement up to the earliest possible expiry date of any existing tenancy.

WE CANNOT BEGIN TO MARKET YOUR PROPERTY WITHOUT THE SIGNED AGREEMENT, ENERGY PERFORMANCE CERTIFICATE, ELECTRICAL & GAS INSPECTION CERTIFICATE AND THE COMPLETED PROPERTY INFORMATION SHEET.

Justlets operates a 7 day cooling off period to ensure all parties are happy with the terms of business No monies will be transferred to Justlets during the cooling off period.

 

Tenant Find Only Service. Initial  Fee starting from £199.... negotiable on multiple property arrangements......deducted from first month's rent.

 

Fully Managed Let 8% of the monthly rental charged. Set up fee starting from £75.00 per property. Fee negotiable on muliple property arrangements.

No Tenancy Renewal Fee to landlord or tenant for Fully Managed Lettings

Additonal Inspection visits to property £25 per visit

Inventories no charge for Fully Managed Lettings.

Gas Safety Certificate per property from £50 including service

Electrical Certificate per property £100 (revised price to meet with the impending legislation changes).

Energy Performance & Floor Plan per property £50

Serving Notices (Section 8/ Section 21) from £25. No charge to Fully Managed Lettings.

Any repairs, parts additional labour may incur additional charges. We will of course advise you in advance of any works being carried out, and seek your approval first. We may ask you to provide fees up-front prior to the being carried out.

You may prefer to instruct your own Trades Persons, all that we ask is that you provide us with the necessary paperwork to conform that the work/s is complete.

At the end of the tenancy we will conduct a property inspection and report our findings to you. Advise of the cost in order that the deduction can be arranged with The Deposit Protection Services were required.

Lettings & Rent Collection

In addition to the above Lettings Only Service, we will provide the following service where you ask us to provide a Lettings and Rent Collection Service during the tenancy:

Demand and collect rent and lodge the deposit with the Government’s custodial scheme, The Deposit Protection Scheme.

Notify you if the rent is not paid or paid late.

Prepare and send you rent statements these can be arranged monthly or quarterly to suit your requirements.

We will send the amount due to you to your bank or building society, generally two weeks in arrears, so if we receive payment from the tenant on the 1st of the month we would pay you on the 15th of the month.

Notify you of any repairs reported by the tenant.

Conduct any additional Inspection Visits to the property, fee to be agreed with you.

Arrange with The Deposit Protection Services to return the remainder of the deposit to the tenant at the end of the tenancy after he/she vacates the property provided that he/she, in our opinion, complied with the terms and conditions of the tenancy, the condition of the property is satisfactory and that the items listed in the inventory/schedule of condition are satisfactory. 

 

Managed Lettings

As no two landlords or tenants are the same, we also offer a Managed Lettings Service on a flexible basis. Let us know how you would like the property to be managed, and we will design our services to suite your requirements. Fees are applied as you need the service.
